Terms and Conditions

These terms are between you and TBD (“we”, “us”) for your use of NightShift AI at meetnightshift.com. By using the site or booking an audit, you agree to these terms. If you do not agree, do not use it.
1. What the service is
NightShift AI provides AI automation for home-service trades: operations audits and system installs. We may change or discontinue features with reasonable notice.
2. Accounts and access
No account is required to browse the site. Booking an audit requires the contact details and payment authorization described at checkout.
3. The audit: price, hold, and guarantee
- Price: $495 total, 50/50. $247.50 (50% down) is authorized as a temporary card hold at booking, captured only if the guarantee is met. The remaining $247.50 is charged only when we have proven you wrong and your blueprint is delivered.
- The guarantee: if we cannot identify automatable busywork equal to at least 10% of a standard 40-hour work week across your operation, the hold is reversed and you keep the audit free. You pay $0, and nothing further is charged.
- What counts: manual, repeatable office and field-support work a system could reasonably do: missed-call handling, estimate follow-up, review requests, inbox triage, bookkeeping prep, reconciliation, COI chasing, inventory reorders, maintenance scheduling, and similar.
- Timeline: intake within 3 business days of booking. Blueprint delivered within 5 business days of completed intake.
- Your blueprint is yours: whether or not you hire us to install anything, the written plan stays with you.
- Holds and charges: the $247.50 hold is released, never charged, if the guarantee triggers or you cancel before the intake call. Completing intake alone never converts the hold to a charge: it is captured only if we find your 10%.
Payments are processed by Stripe. By providing payment details you authorize us to place the hold and, if the guarantee is met, to charge the amounts described here.
4. Refunds
Audit holds are reversed, never charged, if the guarantee conditions are met. Card holds expire automatically if not captured within the card network window (typically 7 days). Install fees, when offered, cover our implementation work only: the software subscriptions your systems run on (messaging, AI services, and similar) are billed separately by their providers.
5. Acceptable use
You agree not to: break the law using the service; attempt to access other users’ data; interfere with or overload the service; misuse the service to send spam or abusive content; or resell the service without our written permission.
6. Your content and data
You keep ownership of content and data you provide. You grant us a limited license to use it only to operate the service for you. We do not use your data to train models for other customers.
7. Intellectual property
The service, its software, and its content are owned by us or our licensors. Nothing here transfers ownership to you.
8. Disclaimers
The service is provided “as is” without warranties of any kind, except where the law requires otherwise. The audit guarantee in section 3 is the performance promise we make, and its exact terms are the ones stated there.
9. Limitation of liability
To the maximum extent allowed by law, our total liability for any claim arising from the service is limited to the greater of $100 or the fees you paid in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.
10. Termination
We may suspend or terminate access for violation of these terms. You may stop using the service at any time.
11. Governing law
These terms are governed by the laws of Arizona, without regard to conflict-of-law rules.
12. Changes to these terms
We may update these terms; material changes will be posted at meetnightshift.com/terms.html with a new effective date. Continued use after the effective date means you accept the changes.
